Emcore Appeals to Federal Circuit After A Determination of Infringement
On November 8, 2010, Emcore Corporation filed a notice of appeal with the Federal Circuit to seek reversal of a determination that it infringed claims 1-3 and 5 of Avago Technologies' U.S. Patent No. 5,359,447 in Inv. No. 337-TA-669, Certain Optoelectronic Devices, Components Thereof, and Products Containing the Same. The Commission has issued a limited exclusion order and cease and desist order against Emcore Corporation's accused products.
