ITC Institutes Inv. No. 827, Certain Portable Communication Devices

 

On January 13, 2012 the ITC voted to institute an investigation of certain portable communication devices.  The products at issue in this investigation are cellular phones, tablet computers, and other such devices. The investigation is based on an amended complaint filed by Digitude Innovations, LLC, of Alexandria, VA, on December 16, 2011.  The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain portable communication devices that infringe patents asserted by Digitude Innovations.  The complainant requests that the USITC issue an exclusion order and a cease and desist order.

ITC Institutes Inv. No. 826 on Electric Fireplaces

On January 13, 2012 the ITC voted to institute an investigation of certain electric fireplaces, components thereof, and manuals for same, processes for manufacturing or relating to same, and products containing same.  The products at issue in this investigation are electric fireplaces and fireplace inserts designed to approximate the look of a real, wood-burning fireplace. The investigation is based on a complaint filed by Twin-Star International, Inc., of Delray Beach, FL, and TS Investment Holding Corp. of Miami, FL, on December 13, 2011.  The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain electric fireplaces, components thereof, and manuals for same, processes for manufacturing or relating to same, and products containing same that misappropriate trade secrets and infringe copyrights asserted by the complainants. The complaints also allege violations of section 337 based on breach of contract and tortious interference with contract.  The complainants request that the ITC issue an exclusion order and a cease and desist order and an order instructing respondents to immediately and verifiably turn over to complainants all documents and things in their possession, custody or control that contain or embody complainants' trade secrets or any information derived from complainants' trade secrets.  The USITC has identified the following as respondents in this investigation: Shenzhen Reliap Industrial Co. of China; Yue Qiu Sheng (aka Jason Yue) of China; and Whalen Furniture Manufacturing Inc. of San Diego, CA.

ITC Votes To Institute Inv. No. 825, Certain Silicon Microphone Packages and Products Containing Same

On January 9, 2012, the Commission voted to institute an investigation of certain silicon microphone packages and products containing same. The products at issue in this investigation are silicon microphone packages.  The investigation is based on a complaint filed by Knowles Electronics, LLC, of Itasca, IL, on December 7, 2011.  The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain silicon microphone packages and products containing same that infringe patents asserted by Knowles Electronics.  The complainant requests that the ITC issue an exclusion order and a cease and desist order.  The ITC has identified the following as respondents in this investigation: Analog Devices Inc. of Norwood, MA; Amkor Technology, Inc., of Chandler, AZ; and
Avnet Inc. of Phoenix, AZ.

Inv. No. 337-TA-818 Instituted

On December 2, the International Trade Commission instituted Inv. No. 337-TA-818, Certain Devices With Secure Communication Capabilities, Components Thereof, and Products Containing the Same, based on a complaint filed on November 4, 2011 by VirnetX, Inc.  The proposed respondent is Apple Inc.

On December 2, the International Trade Commission instituted Inv. No. 337-TA-817, Certain Communication Equipment, Components Thereof, And Products Containing The Same, Including Power Over Ethernet Telephones, Switches, Wireless Access Points, Routers and Other Devices Used in LANs, And Cameras, based on a complaint filed on November 1, 2011 by ChriMar Systems, Inc. The proposed respondents are Cisco Systems, Inc.;Cisco Consumer Products LLC; Cisco Systems International B.V.; Cisco-Linksys LLC; Hewlett-Packard Co.; 3Com Corporation; Avaya Inc.; and Extreme Networks, Inc.

Commission Institutes Inv. No. 337-TA-805

On September 9, 2011 the International Trade Commission issued a notice of investigation against Respondents LG Corporation, LG Electronics, Inc., and LG Electronics, U.S.A., Inc. in Certain Devices for Improving Uniformity Used in a Backlight Module and Components Thereof and Products Containing The Same, Inv. No. 337-TA-805. The Complainants, Industrial Technology Research Institute and ITRI International Inc., allege a violation of section 337 with respect to U.S. Patent No. 6,883,932.

Commission Institutes New Investigation Concerning Certain Portable Electronic Devices and Related Software and Assigns ALJ Gildea

On August 8, 2011, the Commission instituted Inv. No. 337-TA-797, Certain Portable Electronic Devices and Related Software. The Complainant is Apple Inc. The Respondents are HTC Corp., HTC America, Inc., and Exedia, Inc. Apple’s complaint alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain portable electronic devices and related software by reason of infringement of certain claims of US. Patent No. 7,844,915 ("the '915 patent"); US. Patent No. 7,469,381 ("the '381 patent"); US. Patent No. 7,084,859 ("the '859 patent"); US. Patent No. 7,920,129 ("the '129 patent"); and U.S. Patent No. 6,956,564 ("the '564 patent"). The Commission also issued notice that this Investigation has been assigned to ALJ Gildea.

Commission Institutes New Investigation and Assigns ALJ Rogers

The Commission instituted Inv. No. 337-TA-786, Certan Integrated Circuits, Chipsets, and Products Containing the Same, Including Televisions.  The complainant is Freescale Semiconductor, Inc. of Austin, Texas.  Respondents are Funai Electric Co. Ltd., Funai Corporation, Inc., MediaTek Inc.  and Zoran Corporation.  Freescale's complaint alleged violations of 17 U.S.C. section 337 based on the importation into the United States, the sale for importation, and the sale within the United States after importation of certain integrated circuits, chipsets, and products containing the same including televisions by violation of certain claims of U.S. Patent No. 5,467,455.  The Commission also issued notice that this Investigation has been assigned to ALJ Rogers.

Commission Institutes Investigation No. 337-TA-778

On June 16, the Commission issued a notice of investigation, based on a complaint filed May 17, 2011, instituting Inv. No. 337-TA-778, Certain Equipment For Communications Networks, Including Switches, Routers, Gateways, Bridges, Wireless Access Points, Cable Modems, IP Phones, and Products Containing Same.  The complainant is MOSAID Technologies Inc., and the respondents are Cisco Systems, Inc.; Cisco Consumer Products LLC; Cisco Systems International B.V.; and Scientific Atlanta LLC.  The patents asserted to be infringed are U.S. Patent Nos. 7,035,280; 7,292,600; 7,830,858; 6,842,459; 7,633,966; and 5,841,360. The investigation has been assigned to ALJ Gildea.

Inv. No. 337-TA-777 Instituted, Designated "More Complicated"

On June 14, the Commission instituted Inv. No. 337-TA-777, Certain Muzzle Loading Firearms and Components Thereof, based on a complaint and motion for temporary relief filed May 11, 2011 by Thomson/Center Arms Co., Inc. and Smith & Wesson Corp. The patents asserted in the investigation are U.S. Patent Nos. 7,908,781; 7,814,694; 7,140,138; 6,604,311; 5,782,030; and 5,639,981.  The respondents are Dikar Sociedad Cooperativa Limitada; Bergara Barrels Europe; Blackpower Products Inc.; Connecticut Valley Arms; Bergara Barrels North America; Ardesa Firearms; and Traditional Sporting Goods d/b/a Traditions Sporting Firearms. The case has been assigned to ALJ Rogers, who issued an order finding the case "more complicated" due to the request for temporary relief.  Trial on the motion for temporary relief was set for August 8, 2011.  A pre-hearing conference has been scheduled for July 12, 2011.

 

ITC Institutes Investigation Requested by Lutron Electronics Co., Inc.

On June 9, 2011, the International Trade Commission agreed to institute Investigation Number 337-TA-776, regarding Certain Lighting Control Devices Including Dimmer Switches and Parts Thereof. The complainant Lutron Electronics Co., Inc. claims that respondents Pass & Seymour, Inc., AH Lighting, American Top Electric Corp., Big Deal Electric Corp., Diode LED, Elemental LED, LLC, Wenzhou Huir Electric Science & Technology Co. Ltd., Westgate Mfg., Inc., Zhejiang Lux Electric Co. Ltd., and Zhejiang Yuelong Mechanical & Electrical Co. Ltd. are violating section 337 by importing devices that infringe claims of U.S. Patent Nos. 5,248,919, and 5,637,930. The investigation has been assigned to ALJ Essex.

 

ITC Institutes Investigation of Wireless Devices Requested by Linex Technologies, Inc.

On June 2, 2011, the International Trade Commission agreed to institute an investigation regarding Certain Wireless Communication Devices and Systems, Components Thereof, and Products Containing Same. The complainant Linex Technologies, Inc. claims that respondents HP, Apple, Aruba Networks, Meru Networks, and Ruckus Wireless are violating section 337 by importing devices that infringe claims of U.S. Patent Nos. 6,757,322, and RE42,219. The investigation is number 337-TA-775 and has been assigned to ALJ Bullock.

 

ITC Institutes Investigation Based on Complaint By Zenith Electronics

On May 31, 2011, the International Trade Commission agreed to institute an investigation regarding Certain Electronics Devices Having a Digital Television Receiver and Components Thereof. The complainant Zenith Electronics, LLC claims that three Sony respondents are violating section 337 by importing devices that infringe claims of U.S. Patent Nos. 5,598,220, 5,629,958, and 5,636,251. The investigation is number 337-TA-774 and has been assigned to Chief ALJ Luckern.

On November 23, 2010, the Commission issued a Notice of Institution of investigation pursuant to Section 1337: Inv. No. 337-TA-749, In the Matter of Certain Liquid Crystal Display Devices, Including Monitors, Televisions, and Modules, and Components Thereof.  The Complainants are Thomson Licensing SAS and Thomson Licensing LLC.  The Respondents are Qisda Corp., Qisda America Corp., Qisda (Suzhou) Co., Ltd., BenQ Corp., BenQ America Corp., BenQ Latin America Corp., AU Optronics Corp., and AU Optronics Corp. America. The Investigation has been assigned to Robert K. Rogers, Jr.

Commission Issues Notice of Investigation Covering Data Storage Products

The Commission issued a notice of investigation in Inv. No. 337-TA-748, In the Matter of Certain Data Storage Products and Components Thereof.  The complaint, filed October 20, 2010, alleges a violation of Section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain data storage products and components.  The identified products are accused of infringing U.S. Patent No. 6,098,128.  The complaint, filed by Data Network Storage, LLC names NetApp, Inc., Dell, Inc., Xyratex Ltd., Xyratex International Inc., Xyratex (Malaysia) Sdn Bhd, Dot Hill Systems Corp., International Business Machines Corp., Cisco Systems, Inc., and QNAP Systems, Inc. as respondents.

Commission Issues Notice of Investigation Covering Automated Media Library Devices

The Commission issued a notice of investigation in Inv. No. 337-TA-746, In the Matter of Certain Automated Media Library Devices.  The complaint, filed October 19, 2010, alleges a violation of Section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain automated media library devices.  The identified products are accused of infringing U.S. Patent No. 6,328,766 and U.S. Patent No. 6,353,581.  The complaint, filed by Overland Storage, Inc. names BDT AG, BDT-Solutions GmbH & Co. KG, BDT Automation Technology (Zhuhai FTZ), BDT de Mexico, S. de R.L. de C.V., BDT Products, Inc., Dell Inc., and International Business Machines Corp. as respondents.

Commission Issues Notice of Investigation Covering Products Containing Interactive Program Guide and Parental Control Technology

The Commission issued a notice of investigation in Inv. No. 337-TA-747, In the Matter of Certain Products Containing Interactive Program Guide and Parental Controls Technology.  The complaint, filed on October 20, 2010, alleges a violation of Section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain products containing an interactive program guide and parental control technology.  The identified products are accused of infringing U.S. Patent No. 6,305,016, U.S. Patent No. 6,020,929, and U.S. Patent No. 6,701,523.  The complaint, filed by Rovi Corp., Rovi Guides, Inc., United Video Properties, Inc. and Index Systems, Inc. names Toshiba Corp, Toshiba America, Inc., Toshiba America Consumer Products, L.L.C., and Toshiba America Informaiton Systems, Inc. as respondents.

The Complainant is Motorola Mobility, Inc., and the respondent is Apple, Inc.  The investigation has been assigned to Chief ALJ Luckern.

On October 12, 2010, the Commission instituted Inv. No. 337-TA-742, Certain Digital Televisions and Components Thereof, based on a complaint filed September 15, 2010. The Complainants are Thomson Licensing SAS of France and Thomson Licensing LLC of New Jersey. The respondents are Chimei Innolux Corp.; Innolux Corp.; Chi Mei Optoelectronics USA, Inc.; MStar Semiconductor, Inc.; Qisda Corp.; Qisda America Corp.; Qisda (Suzhou) Co., Ltd.; BenQ Corp.; BenQ America Corp.; BenQ Latin America; and Realtek Semiconductor Corp.. On September 22, 2010, the Commission instituted Inv. No. 337-TA-738, Certain Components for Installation of Marine Autopilots with GPS or IMU. The complainant is American GNC of California. The respondents are Furuno Electronics Co., Ltd. of Japan, Furuno U.S.A. Inc. of Washington, Navico Holdings AS of Norway, Navico UK, Ltd. of the United Kingdom, Navico, Inc. of New Hampshire, Flir Systems, Inc. of Oregon, Raymarine UK Ltd. of the United Kingdom, and Raymarine Inc. of New Hampshire. The patent at issue is U.S. Pat. No. 6,596,976.

ITC Institutes Investigation Nos. 337-TA-736 and 737

On September 21, 2010, the Commission instituted Inv. No. 337-TA-736, Certain Wind and Solar-Powered Light Posts and Street Lamps. The Complainants are Duggal Dimensions LLC, Duggal Energy Solutions, LLC, and Duggal Visual Solutions, Inc. of New York. The respondents are Gus Power Incorporated of Canada, Efston Science Inc. of Canada, King Luminaire, Inc. of Ohio, and The StressCrete Group of Canada. The patent at issue is U.S. Pat. No. D610,732.

On the same date, the Commission also instituted Inv. No. 337-TA-737, Certain Liquid Crystal Display Devices and Products Interoperable with the Same. The Complainants are Chimei Innolux Corporation of Taiwan, Chi Mei Optoelectronics U.S.A., Inc. of California, and Innolux Corp. of Texas. The respondents are Sony Corp. of Japan, Sony Corp. of America of New York, Sony Electronics Corp. of California, and Sony Computer Entertainment America, LLC of California. The patents at issue are U.S. Pat. Nos. 6,134,092, 6,671,019, and 5,732,241.

ITC Institutes Inv. No. 337-TA-734

The International Trade Commission instituted Inv. No. 337-TA-734, Certain Adjustable-Height Beds and Components Thereof, on September 2, 2010. The scope of the investigation will cover whether products manufactured by Medical Depot, Inc. and Shanghai Shunlong Physical Therapy Equipment Co., Ltd. infringe U.S. Patent Nos. 6,983,495; 6,997,082; 7,302,716; and 7,441,289.

ITC Institutes Inv. No. 337-TA-780 on Certain Flat Panel Digital Televisions and Components Thereof

The ITC has instituted an investigation based on a complaint filed by Vizio, Inc. (US).  LG Electronics, Inc. (South Korea) and LG Electronics U.S.A., Inc. (US) have been identified as respondents in this investigation.  No ALJ has been assigned to the case yet.

On July 26, 2010, the Commission instituted an investigation entitled Certain Toner Cartridges And Components Thereof, Inv. No. 337-TA-731, based on a complaint filed July 15, 2010. The complainants are Canon, Inc.; Canon U.S.A., Inc.; and Canon Virginia, Inc.  The respondents are Ninestar Image Int'l, Ltd.; Ninestar Technology Co., Ltd. New Investigation 337-TA-730 Instituted

The Commission has instituted an investigation entitled Certain Inkjet Ink Supplies And Components Thereof, Inv. No. 337-TA-730, based on a complaint filed June 25, 2010. The complainant is Hewlett-Packard Co. The respondents are Mipo International, Ltd.; Mextec Group d/b/a Mipo America Ltd.; Shanghai Angel Printer Supplies Co.; Shenzhen Print Media Co., Ltd.; Zhuhai National Resources & Jingjie Imaging Products Co., Ltd.; Tatrix International; and Ourway Image Co., Ltd. The complaint involves allegations of violations of section 337 based upon infringement of U.S. Patent Nos. 6,959,985 and 7,104,630. A formal notice of investigation and assignment of an ALJ should be issued by the ITC within a few days.

No. 337-TA-729, based on a complaint filed June 23, 2010. The complainant is STC.UNM. The respondents are Taiwan Seminconductor Mfg. Co. Ltd. and Samsung Electronics Co. Ltd. The complaint involves allegations of violations of section 337 based upon infringement of U.S. Patent No. 6,042,998.  The investigation has been assigned to ALJ Charneski.
 

New Investigation 337-TA-728 Instituted

On July 13, the Commission issued a notice instituting an investigation entitled Certain Collaborative System Products and Components Thereof (II), Inv. No. 337-TA-728, based on a complaint filed June 15, 2010. The complainant is eInstruction Corporation. The respondents are Promethean Inc. and Promethean Technology Shenzhen Ltd. The complaint involves allegations of violations of section 337 based upon infringement of U.S. Patent Nos. 6,930,673. This is the second investigation filed by eInstruction based on the '673 patent.  The earlier investigation, 337-TA-682, Certain Collaborative System Products and Components Thereof, was terminated on December 16, 2009. 

The investigation has been assigned to ALJ Charneski.

The complaint involves allegations of violations of section 337 based upon infringement of U.S. Patent Nos. 6,268,731. The investigation has been assigned to ALJ Bullock.

The complainant is FlashPoint Technology, Inc. The respondents are Nokia Corp.; Nokia, Inc.; Research in Motion Ltd.; Research in Motion Corp.; HTC Corp.; HTC America, Inc.; LG Electronics, Inc.; LG Electronics U.S.A., Inc.; and LG Electronics MobileComm U.S.A., Inc.  The complaint involves allegations of violations of section 337 based upon infringement of U.S. Patent Nos.6,134,606; 6,163,816; and 6,262,769.  The investigation has been assigned to Chief ALJ Luckern.

On June 25, 2010, the Commission issued a Notice instituting a section 337 investigation entitled Certain Electronic Devices with Image Processing Systems, Components Thereof, and Associated Software, Inv. No. 337-TA-724. The complainants are S3 Graphics Co., Ltd. and S3 Graphics, Inc. The respondent is Apple Inc. The investigation involves allegations of violations of section 337 based upon infringement of U.S. Patent Nos. 7,043,087; 6,775,417; 6,683,978; and 6,658,146.
 

Investigation 337-TA-723 Instituted, Covering Inkjet Cartridges with Printheads and Components

ITC Issues Notice of Investigation In Matter of Biometric Scanning Devices

The International Trade Commission issued a notice of investigation on Friday, June 11, 2010 in Inv. No. 337-TA-720, In the Matter of Certain Biometric Scanning Devices, Components Thereof, Associated Software, and Products Containing the Same. The notice is in response to a Complaint filed by Cross Match Technologies, Inc. on May 11, 2010, as amended on May 26, 2010. The Complaint alleges that proposed respondents, Suprema, Inc. (Korea), and Mentalix, Inc. (Plano, TX) infringe U.S. Patent Nos. 5,900,993; 6,483,932; 7,203,344; and 7,277,562. In a separate notice, Chief Judge Luckern was named the preciding administrative judge for the investigation.
