New Complaint Filed Over the Importation of Electronic Devices for Capturing and Transmitting Images

On January 10, 2012, a complaint was filed on behalf of Eastman Kodak Company against proposed respondents that include Apple, HTC and Exedea.  The complaint alleges the unfair and unlawful importation of electronic devices that capture and transmit images, including smartphones, handheld tablets and video phones, that allegedly infringe Kodak’s U.S. Patent Nos. 7,210,161, 7,742,084, 7,453,605, 7,936,391, and 6,292,218. Kodak seeks a permanent exclusion order and a cease and desists order.

New Complaint Filed by VirnetX Against Apple

On November 4, 2011 VirnetX, Inc. filed a complaint regarding Certain Devices with Secure Communication Capabilities, Components Thereof, and Products Containing the Same. Apple Inc. is named as the only proposed respondent. VirnetX alleges that Apple, Inc. infringes U.S. Patent No. 8,051,181 (the “’181 patent”) for a “Method for Establishing Secure Communication Link Between Computers of Virtual Private Network.” The accused products include, at least, Apple’s iPhone 4, iPhone 4S, iPad 2, iPod Touch, and Macs Running on the “Lion” operating system. VirnetX also filed a related case last week in the U.S. District Court for the Eastern District of Texas alleging that Apple infringes the ’181 patent.

New Complaint Filed Over the Importation of Communication Devices and Equipment

On November 2, 2011, a complaint was filed on behalf of ChriMar Systems, Inc. d/b/a/ CMS Technologies (“ChriMar”) against proposed respondents that include various Cisco entities, HP, 3Com, Avaya and Extreme Networks. The complaint alleges the unfair and unlawful importation of Power over Ethernet telephones, switches, wireless access points, routers and other devices used in WLANs, and cameras, that allegedly infringe ChriMar’s U.S. Patent 7,457,250, including the reexamination certificate thereof, U.S. Patent No. 7,457,250C1. ChriMar seeks a permanent exclusion order and a cease and desists order.
 

New Complaint Filed Over the Importation of Integrated Solar Power Systems

On October 4, 2011, a complaint was filed on behalf of two Westinghouse subsidiaries, Westinghouse Solar Inc. and Andalay Solar Inc., against proposed respondents Zep Solar Inc., Canadian Solar Inc., and Canadian Solar (USA) Inc. The complaint alleges the unfair and unlawful importation of integrated solar power systems that infringe Westinghouse’s U.S. Patents 7,406,800 and 7,987,641. Furthermore, Westinghouse seeks a permanent exclusion order and a cease and desists order.

New Complaint Filed by Furuno Names Honeywell and Skyforce as Proposed Respondents

The ITC received a new complaint on September 30, 2011 filed on behalf of Furuno Electric Co. Ltd. and Furuno USA Inc. (collectively “Furuno”). The complaint alleges that Honeywell International Inc. and Skyforce Avionics Ltd. have violated Section 337 through the importation of “navigation products, components, and related software, including navigational aids, mapping systems and avionics computers” that infringe U.S. Patent Nos. 6,084,565, 7,095,367, 7,089,094, and 7,161,561. Furuno seeks both a permanent exclusion order and a cease and desist order.

On September 22, VIA Technologies Inc., IP-First LLC, and Centaur Technology Inc. filed a letter with Secretary Holbein requesting that the Commission conduct an investigation under section 337 regarding Certain Computing Devices with Associated Instruction Sets and Software. On September 7, 2011, HTC Corp. submitted an amendment to its complaint filed on August 16, 2011 with the ITC.  The amended complaint asserts five additional patents against the sole proposed respondent, Apple, Inc. On May 5, 2010, the Office of the Secretary issued a Notice announcing Inv. No. 332-TA-514, China: Intellectual Property Infringement, Indigenous Innovation Policies, and Frameworks for Measuring the Effects on the U.S. Economy. The investigation follows receipt of a request for two reports from the United States Senate Committee on Finance. The first report will describe the principal types of reported IPR infringement in China, describe China’s indigenous innovation policies, and outline analytical frameworks for determining the quantitative effects of the infringement and indigenous innovation policies on the U.S. economy as a whole and on sectors of the U.S. economy, including lost U.S. jobs. This first report is to be delivered by November 19, 2010. The second report, to be delivered by May 2, 2011, describes the size and scope of reported IPR infringement in China, a quantitative analysis of the impact of reported IPR infringement in China on the U.S. economy and U.S. jobs and on the potential effects on sales, profits, royalties, and license fees of U.S. firms globally, and actual, potential, and reported effects of China’s indigenous innovation policies on the U.S. economy and U.S. jobs, and quantifies these effects, to the extent feasible. On May 4, 2010, Blumberg Industries, Inc. d/b/a Fine Art Lamps (“Fine Art Lamps”) filed a complaint requesting a section 337 investigation.  The proposed respondent is Lights & More, Inc. (“L&M”).  The products involved are lighting products, lamps, and/or lighting fixtures.  Fine Art Lamps alleges that certain lamps and lighting fixture products imported by L&M and sold within the United States infringe one or more claims of U.S. Patent No. D570,038S, “Decorative Element of Lighting Fixtures,” along with other intellectual property rights afforded to Fine Art Lamps under U.S. copyright, trademark, and unfair competition laws.

On May 4, 2010, the Office of the Secretary issued a Notice in the Federal Register announcing Inv. No. 337-TA-714, In the Matter of Certain Electronic Devices with Multi-Touch Enabled Touchpads and Touchscreens.  The complainant, Elan Microelectronics Corporation, alleges violations of section 337 based upon the importation and sale within the United States after importation of certain electronic devices with multi-touch enabled touchpads and touchscreens by reason of infringement of U.S. Patent No. 5, 825, 352.  The respondent is Apple Inc. Georgia-Pacific Files Complaint Alleging Respondents Infringe Four Electronic Paper Towel Dispenser Patents

Georgia-Pacific Consumer Products LP ("Georgia-Pacific") filed a complaint yesterday accusing 11 proposed respondents of infringing U.S. Patent Nos. 6,871,815, 7,017,856, 7,182,289, and 7,387,274 ("Asserted Patents") in Inv. No. 337-TA-___, In the Matter of Certain Electronic Paper Towel Dispensing Devices and Components Thereof.  In its complaint, Georgia-Pacific accuses Kruger Products, KTG USA, Stefco Industries, Cellynne Corp., Draco Hygenic Products, NetPak Electronic Plastic and Cosmetic, NetPak Elektronik Plastik ve Kozmetik Sanayi, Paradigm Marketing Consortium, United Sourcing Network, New Choice, and Vida International of patent infringement.  The Asserted Patents cover methods for "inexpensively and conveniently" grounding electronic paper towel dispensers so that static build-up does not damage the circuitry of electronic dispensers.  Concurrent with the filing of its ITC complaint, Georgia-Pacific also filed suit in the Northern District of Georgia alleging that Kruger, Stefco, Draco, NetPak, and Paradigm infringe the Asserted Patents.  (PDF)
