Notice of Initial Determination
On November 20, 2009, ALJ Charneski issued an Initial Determination in the matter of Certain Cast Steel Railway Wheels, Certain Processes for Manufacturing or Relating to the Same and Certain Products Containing the Same, Inv. No. 337-TA-655. The Initial Determination included the following conclusions of law, among others: (1) the Commission has personal and subject matter jurisdiction; (2) the importation requirement has been met and (3) a violation of section 337 has occurred with respect to the trade secrets owned by complainant Amsted.
