ALJ Grants In Limine Motion to Exclude Expert Testimony
ALJ Charneski in Inv. No. 337-TA-648, In the Matter of Certain Semiconductor Integrated Circuits Using Tungsten Metallization and Products Containing Same, granted complainants’ motion in limine to preclude respondents from offering opinion testimony relating to infringement and validity of the patent-at-issue from the CEO of one of the respondents. ALJ Charneski determined that preclusion was appropriate because respondents did not submit an expert report and thus complainants would have been unfairly prejudiced if the witness provided expert opinion testimony at the hearing.
